Ridehail Program: Waiver and Release

I would like to participate in the ridehail program (Program) coordinated by Vanderbilt University (Vanderbilt). I acknowledge that Vanderbilt coordinates this Program for the convenience of the Vanderbilt community and that my participation in the Program is entirely voluntary.

I understand that there are risks and dangers associated with ridehail and ridesharing, including property damage and physical injury, or even death. I understand that I am accepting rides at my own risk, and that Vanderbilt accepts no liability for any loss or damage to property, or for any physical injury that may occur in connection with may participate in the Program.

I understand that Vanderbilt undertakes no background or insurance checks of drivers. Vanderbilt also does not make any assurances about the condition, suitability, or safety of the vehicles used in the Program. I understand that I must make my own decision about the safety of participating in the Program, including riding with a particular driver and vehicle, before I accept a ride.

For all Lyft rides that I take under this Program, I acknowledge and agree that:

Certain rides require the establishment of a personal account with Lyft prior to the ride;
For rides that do not require establishment of a personal account with Lyft, I allow Vanderbilt to:
a. Transmit a request via the Lyft Platform to available drivers;
b. Send automated transactional communications, including but not limited to SMS texts or phone calls, to me relating to the ride; and
c. Share my name and pick up and drop off locations with the driver who accepts the request.
All of my rides and participation in the Program are subject to the Lyft Terms of Service, including but not limited to the Lyft privacy policy;
Vanderbilt may receive personally identifiable information about my rides, and may use that information solely to benefit the Program;
Lyft may use and store my ride information for the internal purposes of Lyft, subject to its privacy policy; and
Subject to the above restrictions, Vanderbilt and Lyft may share any of the information I provide to either entity under the Program.

To participate in the Program, I CONSENT TO LYFT USING AN AUTOMATED DIALING SYSTEM TO CONTACT ME VIA SMS MESSAGE AND VOICE CALL OR TO LYFT USING THEIR PLATFORM TO CONTACT ME VIA MOBILE APP, MOBILE NOTIFICATION, SMS MESSAGE, AND VOICE CALL. This consent is not a condition of my purchasing any property, goods, or services.

I allow Vanderbilt to transfer my email address to Lyft for commercial email purposes. I also allow Lyft to send commercial emails to me.

I understand that I may end my participation in the Program at any time. If I do, I understand that I must contact Lyft separately to indicate that I no longer wish to be part of the Program.

I understand that I must review and abide by the Vanderbilt Ridehail Safety Guidelines as they are updated. The Guidelines are located at https://www.vanderbilt.edu/movevu/ridehail-safety-guidelines/.

Waiver and Release

In exchange for Vanderbilt providing me the opportunity to participate in the Program, having read and understood this Waiver and Release, I voluntarily agree to RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Vanderbilt University, its affiliates, trustees, officers, employees or agents for any liability, claim, and/or cause of action arising out of or related to any loss, damage, injury or harm of any sort, including physical injury or death, damage to any property belonging to me, and for any data or privacy breach, that may be sustained by me, that occurs as a result of my participation in the Program. It is my intent and agreement that the terms of this paragraph shall bind any person asserting rights on my behalf, or otherwise asserting claims by or through me, including my spouse, domestic partner, family members, heirs, assigns and personal representatives.

By typing or writing my information below, I acknowledge I have read and understand the Ridehail Program Waiver and Release. I also confirm that I am at least 18 years of age.
